Garden waste service terms and conditions

North Somerset Council provides a registration based garden waste collection service, referred to as ‘the service’ in this document. Throughout these terms and conditions, ‘you’ refers to the householder and ‘we’ refers to North Somerset Council.

By registering for the garden waste collection service you accept the following terms and conditions:

Service description

  • Households are required to register for the service. There is a one-off fee of £20 per bin for bins registered by 18 December 2016 and thereafter £25 for each bin registered to the property.
  • Registration includes acceptance of these terms and conditions.
  • Upon registration, all properties will receive a garden waste bin(s). Where a property has been assigned to the grey sacks refuse service, garden waste bags may be supplied if specifically requested.
  • Each property can have a maximum of two bins registered to it (or six bags, where applicable).
  • We empty the bins every two weeks throughout the year except during winter (Dec – Feb) when collections are monthly.
  • Bins will only be collected from registered properties.
  • Garden waste will only be collected from North Somerset Council garden waste bins (or bags where applicable). Garden waste will not be emptied from any other container including the old-style North Somerset garden waste bags.

Ownership and duty of care

  • You are paying to register for the service, not purchasing a bin. All bins will remain the property of North Somerset Council. We will replace bins should they be lost, stolen or damaged unless this is due to the carelessness of the residents.
  • You have a duty of care to look after your bin(s). If your wheeled bin is damaged or lost, there may be a charge for a replacement.
  • Registration is for the property, not for the individual. Bins should therefore remain at the property and not be removed for any reason or taken with you if moving house.
  • You must place your garden waste bin out for collection no earlier than the evening before the assigned collection day and must collect it from the highway on the same day as collection and return it to your property.
  • You must clearly mark your bin with the number or name of your property to avoid any confusion for collection staff.
  • Properties that have bags will receive the first three/six bags as part of their registration. Replacements will need to be purchased from North Somerset Council.

Changes

  • If you wish to exchange your bin(s) for a different size there will be re-registration fee of £10 per bin.
  • If your property is on the bins service and you wish to change to the exception-based bag service (and are eligible to do so) there will be re-registration fee of £10 for each three bags and you will be required to return any bins.
  • If your property is on the exception-based bag service and you wish to change to the bins service you may do so free of charge.

Moving house

  • Registration is for the property, not for the individual. Bins should therefore remain at the property and not be removed for any reason or taken with you if moving house.
  • The service cannot be transferred between properties.
  • If you move into a property that has already been registered you may use the service regardless of whether your previous property was registered. If the property is registered but no bins are present there will be re-registration fee of £10 per bin.
  • If you move into a property that has not been registered for the service you will be required to register and pay the fee regardless of whether your previous property was registered.

Collection arrangements

  • Once you have registered for the service it may take up to 28 working days to deliver your bin and register your details with our collection crews.
  • Garden waste will only be collected from approved bins and no additional garden waste will be collected.
  • Garden waste is collected every two weeks on a specified day, except in winter (Dec-Feb) when it is collected monthly. We reserve the right to alter the collection day and we will publish any changes as soon as we are able. Christmas and New Year collections will vary due to holidays and we will tell you the revised dates well in advance. Other bank holidays are worked as normal days.
  • Garden waste bins must be presented at your usual collection point by 7am on your collection day and no earlier than the evening before. Collection times may vary.
  • After emptying, your garden waste bin(s) will be returned to the collection point. It is your responsibility to ensure that your bin(s) are taken back to your normal storage position on your property. You must take your bins back in as soon as possible after collection and no later than the day of collection. Do not obstruct pavements or roads.
  • An assisted collection service is available if you are physically unable to manage the garden waste bin and no other arrangement can be made. If this service is already in place for your other containers, it will automatically be arranged for your garden waste bin.
  • We endeavour to make all scheduled collections. These may be suspended, such as in severe weather, without notice or compensation. A catch-up collection may not be possible.

  • If we miss your bin(s) we will do our best to return and collect them as soon as possible. You can report a missed collection online.

Acceptable and unacceptable waste

  • Only garden waste may be placed in the bin. This may include; flowers, plants, weeds, grass cuttings, leaves, bark, branches (less than 10cm thick), hedge and tree prunings, fruit and vegetables grown in your own garden, straw or sawdust used for vegetarian pet bedding.
  • Not accepted for garden waste collection; corrugated cardboard, plastic, metal, glass, food waste, soil, turf, stone or rubble, treated wood, branches over 10cm thick, plant pots, cat and dog litter, nappies, vacuum cleaner contents, any other household waste.
  • The garden waste must be placed lose in your bin. Do not put your garden waste into sacks or bags.

Overweight and contaminated bins

  • Bins that are overflowing or overweight will not be emptied. If the bin is too full or overweight it is your responsibility to remove item(s) before the next collection.
  • Garden waste must be within the bin with the lid closed when presented for collection. Excess waste left outside the bin will not be taken.
  • Excessively heavy bins will not be emptied if collection staff consider there is any risk of injury to staff or damage to the bin or vehicle. Lightening the bin is the householder’s responsibility. Bins with frozen contents may not be emptied.
  • If the bin is contaminated (this means it contains non compostable material such as plastic bags, food waste or cardboard) it is your responsibility to remove these item(s) before the next collection. We will not return to empty bins that have been incorrectly presented and it is your responsibility to correct any problems before your next collection.
  • If we cannot empty your bin because the material is jammed in, frozen, or otherwise stuck in the bin, the bin will not be emptied. It is your responsibility to ensure the material is freed before the next collection.
  • Bins that do not meet with the requirements above will not be emptied.

Bin misuse

  • We will accept no liability for bins used for any purpose other than for the collection of garden waste.
  • Customers use the garden waste bins at their own risk.

Exception-based bag service

  • Garden waste bags are available by exception only and restricted to those properties that are currently on the grey sacks service for refuse. All other properties will receive bins.
  • There will be a one-off registration fee of £20 for the bag service if registered by 18 December 2016 and thereafter £25. Each registration covers three garden waste bags, which is equivalent to one bin. In line with the bin service you may make up to two registrations, which would give you an entitlement for up to six bags.
  • There will be a maximum of six bags collected per property.
  • Your first bags will be provided as part of your registration, but you will have to purchase any future replacements from us. You may buy as many bags as you wish but the maximum number that will be collected will be six.
  • It will not be possible to have a combination of bins and bags.
  • If you register for garden waste bags but are not on the grey sacks service, your registration will be invalid.

Variation of terms

We reserve the right to change these terms and conditions at any time and without notification. It is your responsibility to check these terms and conditions for changes. Your continued use of the service following any changes will mean that you accept and agree to the changes. The current draft of these terms and conditions was published on 3 October 2016.

Statutory rights

These terms and conditions do not affect your statutory rights.

Unforeseen circumstances or force majeure

We shall not be liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to acts of God, strikes, lock-outs, accidents, war, fire, extreme weather conditions or breakdown of plant or machinery.
