Privacy notice – spaces and places

Unless otherwise agreed with you, we will only collect the minimum personal data required to deliver the service, which includes your name, address, telephone number(s), email address, application references, client references, job title(s), organisation name(s) and signature(s). It does not include any special category personal information, or information relating to criminal convictions or offences.

The information will be used for the administration of street naming and property numbering, local land charges searches, local land and property gazetteer, landowner statements and declarations, town or village green applications, Community Infrastructure Levy (inc Section 106 Agreements) our statutory duty under the Sections 64 and 65 Towns Improvement Clauses Act 1847 incorporated into s160 of the Public Health Act 1875 for urban areas and wellbeing power under the Local Government Act 2000 for rural areas; Sections 17, Section 18 and Section 19 Public Health Act 1925 and those incorporated under the Local Government Act 1972; Local Land Charges Act 1975 and Rules 1977; Copyright Act 1988; Landowner deposits under section 15A(1) of the Commons Act 2006; Commons Act 2006; The Community Infrastructure Levy Regulations 2010  (GDPR Article 6(1)(c))

The processing of this information is lawful as it is necessary in order to take these steps prior to entering into a contract (GDPR Article 6 (1)(b))

The information will be used to carry out the creation/ updating of official postal addresses, local land charges searches, updates to the local land and property gazetteer; ensure compliance with the public sector mapping agreement; processing landowner statements and declarations; processing town or village green applications, updating the common land and village greens register and management of the Community Infrastructure Levy (inc Section 106 Agreements) our official authority under Sections 64 and 65 Towns Improvement Clauses Act 1847 incorporated into s160 of the Public Health Act 1875 for urban areas and wellbeing power under the Local Government Act 2000 for rural areas; Sections 17, Section 18 and Section 19 Public Health Act 1925 and those incorporated under the Local Government Act 1972; Local Land Charges Act 1975 and Rules 1977; Copyright Act 1988; landowner deposits under section 15A(1) of the Commons Act 2006; Commons Act 2006; The Community Infrastructure Levy Regulations 2010 (GDPR Article 6(1)(e))

The information is used in the interests of public health (GDPR Article 6 (1)(d) and Article 9(2)(i))

We will not use your personal information in a way that may cause you unwarranted nuisance. Failure to provide the information could result in the services required not being processed or being delayed.

The information provided may be shared with council departments, Geoplace, Liberata, Agilisys,  emergency services, Royal Mail, Valuation Office, Western Power, Bristol Water, Land Registry,  solicitors, town or parish councils, personal search agents/ companies, members of the public, who have demonstrated that they have a lawful and legitimate interest in the information, for the purposes of updating their address records, land and property sale transactions, object to proposed road names, view /object to landowner statements and declarations, view/object to town or village green applications;  view common land and village greens register, manage the Community Infrastructure Levy (inc Section 106 Agreements) as referred to in points (a) and (e) above. Your data is never shared or processed outside of the UK

We may lawfully disclose information to public sector agencies to prevent or detect fraud or other crime, or to support the national fraud initiatives and protect public funds under the Local Audit and Accountability Act 2014. Under the conditions of the Digital Economy Act 2017, we may also share personal data provided to us with other public authorities as defined in the Act, for the purposes of fraud or crime detection or prevention, to recover monies owed to us, to improve public service delivery, or for statistical research. We do not share the information with other organisations for commercial purposes.

You have the right to see the personal data we process about you, as well as the right of objection, rectification, restriction and erasure in some circumstances.
