Application No. 03/P/1892/F – Erection of twelve flats, parking and landscaping at land adjoining Walford Avenue/Jesmond Road, Brimbleworth Farm, St. Georges (Agenda Item 6.1)

 

The representative Director of Development and Environment reported on the application.  He referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:   that the application be REFUSED, on the grounds that the proposal represented a loss of open space of recreational value which is contrary to policy R/3 of the North Somerset Local Plan.

Application 02/P/1625/F Proposed erection of an agricultural livestock building at Elborough Farm, Banwell Road, Locking, Weston-super-Mare (Agenda Item 6.2)

 

The representative of the Director of Development and Environment reported on the application.  He referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:   that the application be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       No work shall commence until samples of the timber cladding and roof cladding, demonstrating its colour and texture has been submitted to and approved, in writing, by the Local Planning Authority.

3.       No development shall commence until details of the boundary hedge to the east of the building hereby approved, including the species, spacing and stock size has been submitted to and approved, in writing, by the Local Planning Authority

4.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive completion of the development.

5.       Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without the prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

6.       No development shall commence until foul and surface water drainage details have been submitted to and approved, in writing, by the Local Planning Authority.

7.       The site shall be drained on a separate system with all the clean roof and surface water being kept separate from foul drainage.

The representative of the Director of Development and Environment reported on the application.  He referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:   

 

(1)     that the application be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       No work shall commence until samples of the timber cladding and roof cladding, demonstrating its colour and texture has been submitted to and approved, in writing, by the Local Planning Authority.

3.       No development shall commence until further details of a landscaping scheme, including the species, spacing and stock size has been submitted to and approved, in writing, by the Local Planning Authority

8.             The stables hereby permitted shall be used for private purposes and no more than three horses shall be accommodated within the stables or on the site at any time, and

 

(2)      that Enforcement Action including any court action if applicable, be taken to remedy the breach of planning control, subject to consultation between the Director of Planning and Environment and the Solicitor to the Council.


 

Advice Notes

 

1.       Any manure/dung heaps must be sited in an area where they will not cause pollution of any watercourse or water source by the release of contaminated run-off

 

2.       Under the terms of the Control of Pollution (Silage, Slurry and Agricultural Fuel Oils) Regulations 1991, the person who proposes to have control over any relevant storage installation is required to serve notice on the Environment Agency specifying the type of structure to be used and its location at least 14 days before it is to be used for keeping or storing any relevant substance.

The Director of Development and Environment reported on the application. 

 

RESOLVED:   that the application be APPROVED with the following conditions:

 

1.         The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.         No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

3.         No part of the building hereby permitted shall be used as habitable residential accommodation.

4.         Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no windows, rooflights or dormers shall be inserted into any part of the rear (west) elevation which faces onto Dundry Lane, without the prior written consent of the Local Planning Authority.

5.         The garage and playroom hereby permitted shall not be used except for private and domestic purposes and shall at no times be used for any commercial or business purposes whatsoever.

6.         No development shall take place until further details of a landscaping scheme have been submitted to and approved, in writing, by the Local Planning Authority.

7.         All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following completion of the development.

RESOLVED:   that the application be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       The garage hereby permitted shall not be used except for private and domestic purposes and shall at no times be used for any business or commercial purposes whatsoever.

3.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, roof lights or dormers shall be inserted in the garage hereby permitted without the prior written consent of the Local Planning Authority.

4.       No development shall be commenced until drainage details including land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing, by the Local Planning Authority.

5.       The garage door to the west elevation shall be timber unless an alternative design is submitted to and approved in writing by the Local Planning Authority.

The Solicitor to the Council presented a report.

 

RESOLVED:   that a Certificate of Lawfulness be granted for an existing use of the workshop, Collum Lane, Kewstoke as a workshop for service and repair of motor vehicles, described as follows:

 

(a)     the workshop is operated from 8.00 a.m. to 6.00 p.m. Monday – Saturday and 9.00 a.m. – 1.00 p.m. on Sundays;

 

(b)     Up to 14 vehicles (including up to 2 HGVs) are repaired/serviced on a daily basis; and

 

(c)     Up to 6 other vehicles are parked on the hard surface surrounding the workshop.

 

The Certificate should be granted on the ground that the use began more than ten years before the date of the application.

RECOMMENDED TO THE LEADER OF THE COUNCIL:   that subject to the approval by the Central Area Committee, North Area Committee and West Area Committee the grant for Safety Zone 2000 in the sum of £1,000 be approved.

Mr. Russell drew to the meeting’s attention the concerns of Banwell Parish Council and clarification on details in the report on Updating and Screening Assessment 2003.

 

·                    clarification for nitro dioxide levels in houses

·                    the measurements from diffusion tubes at 27 microns.  Is this measurement good or bad?

·                    questioned highest concentration of levels near school

·                    clarifications on how predictions made

·                    different methods of monitoring and the results

 

(1)        Members requested that they be circulated with copies of the Updating and Screening Assessment 2003. report

 

(2)        Members requested that the Executive Member for Strategic Planning be given a copy of submitted questions and answers regarding impending public meetings, and

 

(3)        that claims by Banwell Parish Council regarding increased cases of asthma in comparison to near parishes be checked by the Primary Care Trust.
