Planning Application No. 03/P/1179/F Demolition and erection of 53 sheltered apartments for the elderly including house managers accommodation, communal facilities, car parking, landscaping and access at former St. Peter’s School, High Street, Portishead (Agenda Item 6.1)

 

The Director of Development Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:   that subject to the completion of a legal agreement securing (a) financial contribution towards affordable housing (b) financial contributions to off site public open space (c) the occupancy of the sheltered housing to be restricted to persons aged 55 years or older and subject to the application being referred to the Secretary of State as a departure from the development plan, Planning Application No. 03/P/1179/F be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no gates, fences, walls or other means of enclosure shall be erected or constructed in front of the dwelling, other than those expressly authorised by this permission, in writing, of the Local Planning Authority.

3.       The developer shall afford access at all times to any archaeologist nominated by the Local Planning Authority, and shall allow him or her to observe the excavations and record items of interest and finds.

4.       No development shall take place until details of a landscaping scheme have been submitted to and approved, in writing, by the Local Planning Authority.

5.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the building or completion of the development, whichever is the sooner.           

6.       No development shall commence until a scheme has been submitted and approved by the Local Planning authority for the removal of the current radius entry to the site from the footway adjacent to the northern boundary. The agreed scheme shall be fully implemented before any of the buildings hereby approved are first occupied.

7.       The apartments hereby approved shall not be occupied until sight lines have been provided at the junction of the vehicular access to the site with the High Street in accordance with details to be submitted to and approved, in writing, by the Local Planning Authority.  At no time shall landscaping be planted within the area of the approved visibility splays.

8.       No development shall be commenced until plans showing adequate parking provision for residential development have been approved by the Local Planning Authority.  The agreed parking areas shall be properly laid out and surfaced before any dwellings are occupied and shall not be used except for the parking of vehicles in connection with the development hereby permitted.

9.       No development shall be commenced until drainage details including land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing,  by the Local Planning Authority.

10.     The development shall not be commenced until details of the proposed replacement railings to the High Street frontage have been submitted to and approved in writing by the Local Planning Authority. The agreed scheme shall be fully implemented prior to the building being occupied.

11.     No work shall be commenced until details of the materials (including re-use of existing materials on site and the colour) to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

12.     Any stone resulting from the demolition of the existing school buildings shall be retained for use in the proposed development unless otherwise agreed in writing with the Local Planning Authority.

13.     Notwithstanding the submitted details no development shall be commenced until sample panels of the proposed external materials including balconies, walling materials for the buildings, and walling materials for all boundary walls have been erected on the site and approved in writing by the Local Planning Authority.  Thereafter, the materials to be used in the development hereby permitted shall be in accordance with the approved details.

14.     No apartment shall be occupied until bins and bin stores have been provided on site in accordance with detailed plans and specifications to be submitted to and approved by the Local Planning Authority.

15.     No apartment shall be occupied until a scheme of external lighting (which shall include details of the design of the means of illumination and a lighting contour plan) has been installed in accordance with details to be submitted to and approved by the Local Planning Authority.

16.     Prior to the occupation of any of the dwellings, hereby approved, the developer shall remove, to the satisfaction of the Local Planning Authority, the school markings in the highway to the frontage of the site.

17.     Prior to the occupation of any of the dwellings, hereby approved, the developer shall re-form the junction of the High Street and the path to the north of the development to a raised footway crossing.


 

Advice Note

 

The applicant will need to enter into an agreement with the Local Planning Authority for the design and implementation of any works on the public highway. The applicant is advised to contact Highway Services on 01275 882001

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

A proposition for deferment that was duly seconded and debated was LOST.  It was subsequently,

 

RESOLVED:   that Planning Application No. 03/P/2130/RM be APPROVED subject to the following conditions:

 

1.       Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, no garage shall be converted to habitable accommodation without the prior permission, in writing, of the Local Planning Authority.

2.       Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, no gates, fences, walls or other means of enclosure shall be erected or constructed in front of the forwardmost part of the front of the dwellings, other than those expressly authorised by this permission, without the permission, in writing, of the Local Planning Authority.

3.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, rooflights or dormers shall be inserted in the dwellings without the prior written consent of the Local Planning Authority.

4.       The dwellings shall not be occupied until the parking and garaging spaces have been provided, together with vehicular access thereto, in accordance with the approved plans. The access and parking spaces shall be used for no other purpose.

 

Advice Note:

 

This development includes highways (a turning area) which will be offered for adoption as public highways. The developers attention is drawn to the need for a S 38 agreement under the Highway Act 1980 and that no works of construction of the affected roads should be carried out prior to the agreement being in place.

RESOLVED    that Planning Application No. 03/P/2127RM be REFUSED for the following reasons:

 

1.      The proposed development would be out of keeping with the largely single-storey development surrounding it and would be detrimental to the character of the area contrary to Policy HOU/2 of the North Somerset Local Plan.

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

A proposition for refusal was not seconded.  It was subsequently,

 

RESOLVED:   that Planning Application No. 03/P/2128/F be APPROVED subject to the following conditions:

 

1.      The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.      The development hereby permitted shall be carried out in complete accordance with the approved plans and specifications (unless amended plans and specifications are first submitted to and approved, in writing, by the Local Planning Authority).

3.      Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no extensions or external alterations or additional windows to the dwelling shall be carried out without the permission, in writing, of the Local Planning Authority.

4.      No development shall be commenced until the access and turning area have been approved by the Local Planning Authority.  This area shall be properly consolidated and surfaced before the dwelling is occupied and the parking and turning areas shall not be used except for the parking and turning of vehicles in connection with the development hereby permitted.

5.      No development shall be commenced until drainage details including land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing,  by the Local Planning Authority.

6.      No work shall be commenced until the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

7.      The development shall not begin until a scheme to deal with contamination of the site has been submitted to and approved in writing by the Local Planning Authority.  The above scheme shall include an investigation and assessment to identify the extent of contamination and the measures to be taken to avoid risk to the public/building/environment where the site is developed.  Development shall not commence until the measures approved in the scheme have been approved and implemented.

8.      Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 or any Order revoking and re-enacting that Order, no tank for the storage of oils, fuels or chemicals shall be erected within the curtilage of a dwellinghouse unless it is sited on an impervial base and surrounded by impervious bund walls.  The volume of the bunded compound should be at least equivalent to the capacity of tank plus 10%.  All filling points, vents, gauges and site glasses must be located within the bunds.  The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata.  Associated pipe work shall be located above ground and protected where possible from accidental damage.

A proposition for a site meeting was duly seconded and debated but was subsequently withdrawn.  It was,

 

RESOLVED:   that Planning Application No. 03/P/1951/F be REFUSED for the following reasons

 

1.      The proposed use would be inappropriate to the Lake Grounds which are an Unregistered Historic Park.  The proposal is therefore contrary to Policies CON/9, ARCH/15 of the North Somerset Local Plan, and the advice of Planning Policy Guidance Note 15.

Planning Application No. 03/P/1621/F Erection of two-storey dwelling house at garden plot, Avenue House, 3 Beach Road West, Portishead (Agenda Item 6.6)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:   that Planning Application No. 03/P/1621/F be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       The dwelling shall not be occupied until drainage works to serve the development hereby permitted have been completed in accordance with details to be submitted to and approved, in writing, by the Local Planning Authority. Once approved the development shall be carried out in accordance with the approved details.

3.       No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

4.       No walls shall be constructed until a sample panel of the render is made available on site and approved, in writing, by the Local Planning Authority.  The development shall be completed in accordance with the approved details.

5.       Prior to the occupation of the house hereby approved, the boundary fence shall be erected in accordance with the approved plan 620.F.1A.

6.       The dwelling shall not be occupied until a properly consolidated and surfaced parking area for vehicles for that dwelling has been constructed in accordance with the approved plans.  The approved parking area shall thereafter be kept available for car parking at all times.

7.       All window frames, external doors and door frames shall be set back a minimum of 125mm from the external face of wall and shall be finished to the written satisfaction of the Local Planning Authority.

8.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, rooflights or dormers shall be inserted without the prior permission of the Local Planning Authority.

9.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, the first floor windows on the east elevation shall be glazed permanently with obscure glazing.

10.     Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order revoking and re-enacting that Order, no extensions or external alterations to the dwelling shall be carried out without the permission, in writing, of the Local Planning Authority.

11.     For the duration of the development works all existing trees shall be protected by a suitable barrier erected and maintained at a distance from the trunk specified in writing by the Local Planning Authority.  The Authority shall be informed at least 7 days before work starts on site so that the barrier positions can be established.  Within this protected area there shall be no excavation, tipping or stacking nor compaction of the ground by any other means.

12.     No development shall take place until details of a landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The development shall take place in accordance with the approved scheme.

13.     All works comprised in the approved details of the landscaping scheme should be carried out during the months of October to March inclusive following occupation of the dwellings or completion of the development, whichever is sooner.

14.     Trees, hedges and plants shown in the landscape scheme to be retained or planted which, during the development works on a period of 10 years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

Area Committee Budget Bidding (Agenda Item 7)

 

The Area Committee considered applications submitted for financial assistance under the Budget Bidding process.

 

RECOMMENDED TO THE LEADER OF THE COUNCIL:

 

(1)     that the application submitted by the Avon Wildlife Trust and Councillor Gething for access improvements and way marking at Weston Big Wood Nature Reserve be approved in the sum of £ 2,000;

 

(2)     that the application submitted by the Cadbury Wind Band and Councillor Bates for the purchase of music, improved storage and retrieval in the Band’s library, and overhaul of instruments be approved in the sum of £ 500; and

 

(3)     that the application submitted by Portishead in Bloom and Councillor Daws for the construction of new carousels and winter planting in the High Street be approved in the sum of ££2,000.
