Public Speaking at Area Committees under Standing Order No. 17  (Agenda Item 1) – NON PLANNING MATTERS

 

Mr. Abrahams addressed the Committee and spoke of the traffic problems at Church Road, Winscombe.  He referred to the Council’s proposals, which were insufficient to overcome the nature of the problems experienced.  This area was recognised nationally as a problem.  He urged that further steps be taken before the problem got worse.

 

The Chairman suggested that a meeting be arranged between the Ward Members, parish council, residents and highways officers.  She requested that Mr. Abraham supply her with copies of correspondence supporting his statements which would be great help.

Public Speaking at Area Committees under Standing Order No. 17A (Agenda Item 1) – PLANNING MATTERS

 

Mr. R. Holder addressed the Committee and spoke against planning application no. 03/P/1402/F – Erection of a dwelling at Littlers, Ropers Lane, Wrington (Agenda Item 6.2).  He highlighted the following points:-

 

-               the size of the plot in comparison to the proposed dwelling,

-               concerns on the effect on trees on the site,

-               breach of the old stone wall,

-               parking space and building materials proposed.

-               the background of the application,

-               design of site,

-               access and visibility of site.

Mr. Hammett addressed the Committee and spoke against 03/P/1865/F – Erection of ten affordable dwellings on land off Regil Lane, Winford.  He highlighted the following points:-

 

-               the development was not in accordance with the development plan,

-               it was outside the settlement boundary,

-               he was concerned with access to the village and schools via footpaths, and sustainability of the project.

-               there was a proven need for the development,

-               the history of the search for a suitable site,

-               the development was adjacent to the village,

-               traffic issues,

-               the sit met necessary criteria for approval.

RESOLVED:  that the minutes of the meeting, subject to it being noted that Minute No. SAC 63 was a decision of the Area Committee (Part 2 item) not a recommendation to the Planning and Regulatory Committee be approved as a correct record and signed by the Chairman.

PART 2 – DECISIONS OF THE AREA COMMITTEE

Application No. 03/P/1865/F – Erection of 10 affordable dwellings on land off Regil Lane, Winford (Agenda Item 6.1)

 

The Director of Development and Environment reported on the application.  He referred to the update sheet copy, a copy of which is filed on the signed Minute Book.

 

RESOLVED:  that subject to (a) the referral of the application to the Secretary of State as a departure from development plan and (b) subsequent completion of a legal agreement securing a restriction on occupancy of the units in accordance with Policy HOU/12 and to secure financial contributions towards the maintenance of public open space to be provided within the site; the application be APPROVED subject to the following conditions: -

 

1.                   The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                   The dwellings hereby granted shall not be occupied until the vehicle entrance point from Regil Lane including the footpath link into the site from Regil Lane and associated visibility splay, turning areas, parking spaces, have been constructed in accordance with the approved drawings and are available for use.  The visibility splay shall be kept free of obstruction at all times including vegetation and the car parking spaces shall be retained at all times and shall not be used for other purposes without the prior consent of the Local Planning Authority.

3.                   The finished ground levels, slab levels and ridge heights of the dwellings as shown on the approved drawings, shall not be raised unless otherwise agreed in writing by the Local Planning Authority.

4.                   Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no extensions or external alterations to the dwellings shall be carried out without the permission, in writing, of the Local Planning Authority.

5.                   No development shall be commenced until drainage details including surface water, foul water and land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing, by the Local Planning Authority.

6.                   For the duration of the development works existing hedges and/or trees shall be protected by a suitable barrier erected and maintained at a distance from the trunk or hedge specified, in writing, by the Local Planning Authority.  The Authority shall be informed at least seven days before works start on site so that barrier position can be established.  Within this protected area there shall be no excavation, tipping or stacking, nor compaction of the ground by any other means.

7.                   No development shall take place until details of hard and soft landscaping scheme have been submitted to and approved, in writing, by the Local Planning Authority.

8.                   All soft landscaping works in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the building or completion of the development, whichever is the sooner.

9.                   The Council shall be given at least 14 days prior written notice of any works to relocate existing hedgerows as part of the landscaping scheme and that the method of carrying out such works and subsequent protection of the hedgerows shall be submitted to and approved before the works are carried out. 

10.               Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season  with others of such species and size as the Authority may specify.

11.               No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

12.               No development shall commence until a scheme to deal with noise attenuation for the dwellings hereby approved in response from aircraft noise and an adjoining engineering business, has been submitted to and approved in writing by the Local Planning Authority.  The approved scheme shall be fully implemented before the flats are occupied.

 

Advice Notes

 

You are advised that:

 

1.         During construction the following pollution prevention measures must be adopted, where applicable:

 

(a)     Pumps used for pumping out water from excavations should be sited well away from watercourses and surrounded by absorbent material to contain oil spillages and leaks.

 

(b)     Discharge of silty or discoloured water from excavations should be irrigated over grassland or a settlement lagoon be provided to remove gross solids.  The Environment Agency must be advised if a discharge to a watercourse is proposed.

 

(c)     Storage of fuels for machines and pumps should be well away from any watercourses.  The tanks should be bunded or surrounded by oil absorbent material (regularly replaced when contaminated) to control spillage and leakage.

 

(d)         The Environment Agency must be notified immediately of any incident likely to cause pollution to groundwater or surface waters.

Application No. 02/P/1234/F – Erection of a dwelling at Littlers, Ropers Lane, Wrington (Agenda item 6.2)

 

The Director of Development and Environment reported on the application.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.                  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                  No walls shall be constructed or rebuilt until sample panels of the stonework demonstrating the colour, texture, face bond, and pointing are erected on site and approved in writing by the Local Planning Authority.  The development shall be completed in accordance with the approved details.

3.                  No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority.  The development shall be carried out in the approved materials unless otherwise agreed in writing.

4.                  No development shall be commenced until foul and surface water drainage details have been submitted and approved by the Local Planning Authority.

5.                  All works shown in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the dwelling or completion of the development whichever is the sooner.

6.                  Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without the prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

7.                  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any Order revoking and re-enacting that Order, no windows or other openings, other than those approved under this permission, shall be inserted into any part of the east or west elevation of the dwelling, without the permission, in writing, of the Local Planning Authority.

8.                  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any Order revoking and re-enacting that Order, no extensions or alterations to any part of the roof, including the insertion of any roof lights, shall be carried out without the permission, in writing, of the Local Planning Authority.

9.                  The dwelling hereby permitted shall not be occupied until the approved block paved driveway has been constructed in accordance with drawing number RES/P/110A.

10.              For the duration of the development works the existing Horse Chestnut Tree shall be protected by a suitable barrier and maintained at a distance from the trunk specified in writing, by the Local Planning Authority.  The Local Planning Authority shall be informed at least seven days before the works start on site so that the barrier position can be established.  Within this protected area there shall be no excavation, tipping or stacking, nor compaction of the ground by any other means.

 

Advice Note

 

Any new works within the highway footway to form an access must be to the Council’s specification and prior to any works commencing the developer must arrange with the Council’s Highway Services Division (01275 882001) for the approval of the works within the highway.

2.                   Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows shall be inserted in the north or south elevations of the extension hereby permitted without the prior written consent of the Local Planning Authority.

Area Committee – Budget Bidding (Agenda Item 7)

 

The Committee received a report from the Funding Advisory Service presenting applications for financial assistance under the Budget Bidding Process.

 

RECOMMENDED TO THE LEADER OF THE COUNCIL:

 

(1)          that the bid in respect of Bleadon Coronation Hall in the sum of £2,385 be APPROVED.

 

(2)          that the bid in respect of Wrington Bowling Club in the sum of £5,000 be APPROVED.

 

(3)          that the bid in respect of All Saints Church, Sandford in the sum of £600 be APPROVED.

LOCKING PARISH COUNCIL

 

“Members of Locking Parish Council are concerned that residents living in Grenville Avenue have applied to purchase the lock-up garage they are currently using and have been refused by North Somerset Council without any concrete reason being given.  Please can the reasons for this refusal be ascertained”.

 

Mr. Dumbell explained that this question had arisen via verbal requests by residents of Grenville Avenue.  Their comments had included:

 

a)             they wished to purchase garages for use to garage their cars,

b)             some garages not owned by people in the village;

c)             some not used as garages for cars but as storage areas;

d)             Grenville Avenue narrow street.

 

The main concerns were a) the apparent inconsistencies of the application of the policy and b) were there circumstances where council garages could be for sale.

 

Members requested that they all be circulated with copies of the relevant policies and Locking Parish Council particularly in the event of the impending Housing Option decision that needed to be made and a more detailed explanation by Housing Officers be given.

 

Members expressed disappointment that a representative of Housing and Social Services was not available to attend the meeting, although they understood why and had always been well served from officers from Development and Environment.

 

The Chairman advised that a meeting of housing officers etc. regarding the Housing Options Working Party had been taking place at the same time of this meeting and referred to the guidance on Parish Voice notes.
