Public Speaking at Area Committees under Standing Order 17A (Agenda Item 1) – Mr. Coote

 

Mr. Coote addressed the Committee and spoke against Planning Application 03/P/0121/F – Proposed erection of timber clad pig breeding buildings and retention of existing pig pen and run on land adjacent to Walnut Barn, Church Lane, Hutton.  He considered that if the applicant revised the application by more sensitive siting of the breeding units, properly constructed drainage facilities and controlled management, this would satisfy adjacent neighbours, Hutton Parish Council and other residents worried about the prospect of polluted surface run-off.

Public Speaking at Area Committees under Standing Order 17A (Agenda Item 1) – Mr. Orchard

 

Mr. Orchard, the applicant, spoke in favour of Planning Application 03/P/0121/F - Proposed erection of timber clad pig breeding buildings and retention of existing pig pen and run on land adjacent to Walnut Barn, Church Lane, Hutton.  He responded to the following points:

 

·               odour/hygiene issues

·               drainage issues

·               history of site

Public Speaking at Area Committees under Standing Order 17A (Agenda Item 1) – Mr. Wroath

 

Mr.Wroath, the applicants, addressed the Committee and spoke in favour of Planning Application 03/P/0785/F – Erection of a first floor extension at Normandy House, Church Street, Blagdon.  He addressed the following issues contained in the Acting Director of Development and Environment’s report:

 

·               serious overlooking issue

·               irreparably damage the Conservation Area

·               amendments to the planning application

·               siting of windows

 

He concluded by stating that they had worked hard to produce a design that would complement the property and preserve the character of the area and were surprised at the opposition since expressed.

Application 03/P/0121/F – Proposed erection of a timber clad pig breeding building and retention of existing pig pen and run on land adjacent to Walnut Barn, Church Lane, Hutton (Agenda Item 6.1)

 

The Acting Director of Development and Environment presented the report.  He referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:  that the application be REFUSED for the following reasons:

 

The form and appearance of the development would have an adverse impact on the Area of Outstanding Natural Beauty and on the character of the Conservation Area contrary to policies AONB/1 and CON/13 of the North Somerset Local Plan and policies ECH/3 and ECH/9 of the draft North Somerset Replacement Local Plan September 2002.

Application 03/P/1223/RG3/F – Variation of condition 6 of planning permission 01/P/1431/RG3, in order to vary the times for delivery and removal of materials associated with approved building works.  The changes are from 0930 hours to 1400 hours (as previously approved) to 0800 hours to 0830 hours, 0930 hours to 1500 hours, 1545 hours to 1700 hours on Mondays to Fridays and 0900 hours to 1300 hours on Saturdays, with no use on Sundays or Bank Holidays, at Hutton Primary School, Church Lane, Hutton (Agenda Item 6.2)

 

The Acting Director of Development and Environment presented a report.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.         The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.         The new community hall shall only be used between 08.00 hours and 22.30 hours Mondays to Thursdays, 08.00 hours to 23.00 hours on Fridays and Saturdays and 09.00 to 13.00 hours on Sundays.

3.         Any amplified music (live or pre-recorded), public address systems or any other amplified sounds that are operated from within the extension hereby permitted, shall not be audible from the nearest residential property.       

4.         No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

5.         No development shall be commenced until drainage details including land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing,  by the Local Planning Authority.

6.         There shall be no deliveries to the site or removal of building materials from the site associated with the construction of the development hereby permitted, except between 08.00 hours to 08:30 Hours, 09:30 Hours to 15:00 Hours and 15:45 Hours to 17:00 Hours Mondays to Fridays and 09:00 Hours to 13:00 on Saturdays.

7.                 There shall be no vehicle movements associated with the construction of the development hereby permitted to or from Robin Drive, until the route and surfacing of a temporary access road has been approved by the Local Planning Authority.  This temporary road shall be removed and the ground returned to its former condition once the development is completed.

The Acting Director of Development and Environment reported that this application had been WITHDRAWN.

Application 03/P/0785 – Erection of a first floor rear extension at Normandy House, Church Street, Blagdon (Agenda Item 6.4)

 

The Acting Director of Development and Environment presented the report.

 

The Committee did not consider that the application would adversely affect neighbouring properties and due to the mixed style of building in the vicinity, would not adversely affect the character or appearance of the Conservation Area.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.      The development hereby shall be begun before the expiry of five years from the date of this permission.

2.      Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, roof lights or dormers shall be inserted in the north, south or east elevations without the prior written consent of the Local Planning Authority.

3.      The external walling and roofing materials to be used in the building works hereby permitted shall be identical to those in the existing building and shall not include hanging tiles as indicated on the approved plans but render.  If any other material is proposed no development shall take place until such has been approved, in writing, by the Local Planning Authority.

The Acting Director of Development and Environment presented the report.  He referred to the update sheet, which included amended plans, a copy of which is filed on the signed Minute Book.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.                  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, roof lights or dormers shall be inserted in the north or west elevations of the extension without the prior written consent of the Local Planning Authority.

3.                  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, the windows in the north elevation shall be glazed permanently with obscure glazing.

4.                  The garage hereby permitted shall not be used except for private and domestic purposes and shall at no times be used for any commercial or business purposes whatsoever.

Application 03/P/1280/LB – Remedial structural work to small roof adjacent to entrance porch at Wrington VC Primary School, School Road, Wrington (Agenda Item 6.6)

 

 

The Acting Director of Development and Environment presented the report.  He referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:  that the Listed Building be referred to the Secretary of State with a recommendation of APPROVAL subject to the following conditions:

 

1.                  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                  All new external and internal works and finishes, and works of making good, shall match the existing original work in respect of materials used, detailed execution and finished appearance except where indicated otherwise on the drawings hereby approved.

3.                  Prior to works commencing on works associated with the repair, replacement or treatment of the roof or floor timbers the appointed builder(s)/craftsmen shall identify and agree on site with an officer appointed by the Council the extent of all damaged and decayed timbers and the measures necessary to carry out the appropriate repair, replacement or treatment.  The development shall be completed in accordance with the agreed programme.

Application 03/P/1047/F3 – Renewal of 98/0675 for the conversion of existing stable and garage into 2 holiday flats at Arben Bloom, Churchill Green, Churchill (Agenda Item 6.7)

 

The Acting Director of Development and Environment presented the report.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.                 The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                 The external walling and roofing materials to be used in the building works hereby permitted shall be identical to those in the existing building.  If any other material is proposed no development shall take place until such has been approved, in writing, by the Local Planning Authority.

3.                 The development hereby permitted shall be carried out in complete accordance with the approved plans and specifications (unless amended plans and specifications are first submitted to and approved, in writing, by the Local Planning Authority).

4.                 The use of the accommodation hereby permitted shall be restricted to self-catering tourist accommodation only, and shall not be occupied as permanent residential accommodation at any time.

5.                 All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the buildings or completion of the development, whichever is the sooner.

6.                 Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

The Acting Director of Development and Environment presented a report on the unauthorised use of the land for the provision of off-site car parking in conjunction with Bristol Airport on various sites in the vicinity.  The following minutes (reference nos.  SAC 33, SAC 34, SAC 35, SAC 36 and SAC 37) refer to individual cases.

02/P/0699/F – Alterations and extension to rear of premises to provide hotel accommodation with additional car parking spaces, The George & Dragon, 52 Stanshalls Lane, Felton – Mr. Bruce Schofield – APPEAL PART ALLOWED  (Conversion of  8 outbuildings to provide 8 letting bedrooms) and PART DISMISSED (Erection of two storey building to provide 7 letting bedrooms and change of use of adjoining land to provide 33 additional parking spaces).

Members received a report from the Solicitor to the Council giving details of an application for a Certificate of Lawfulness for an existing use of Myrtledene, 27 Greenhill Road, Sandford as a single dwellinghouse with associated residential garden.

 

RESOLVED:  that a Certificate of Lawfulness for an existing use of Myrtledene, 27 Greenhill Road, Sandford as a single dwellinghouse with associated residential garden be GRANTED on the ground that the use began more than ten years before the date of the application.

Area Committees – Budget Bidding (Agenda Item 8)

 

Members received a report from the Customer Services Officer on applications for financial assistance under the Budget Bidding Process.

 

RESOLVED TO RECOMMEND TO THE LEADER OF THE COUNCIL:

 

(1)          that the bid in respect  of Blagdon and Butcombe Youth Week towards the cost of providing a variety of activities for local children in August in the sum of £600.00  be APPROVED.

(2)         that the bid in respect Banwell Parish Council towards the cost of urgent repairs to the cemetery wall in the sum of £5,000 be REFUSED.

 

(3)         that the bid in respect of Burrington Parish Council to fund the additional cost of decorative village name plates for Rickford in the sum of £228.24 be REFUSED.

 

(4)         that the bid in respect Winford Parish Council towards the cost of installing a 40m stretch of fence enclosing the children’s play area in the sum of £2,500 be DEFERRED for further investigation by the local Ward Member.
