RESOLVED:  that Councillor Crockford-Hawley be elected Chairman of the Committee for the municipal year 2003/04 (the voting was unanimous).

Public Speaking at Planning Committees under Standing Order 17A (Agenda Item 1)

Mrs. S. Whittle – Headteacher, Castle Batch Primary School

 

Mrs. S. Whittle, Headteacher, Castle Batch Primary School, addressed the Committee on behalf of the School’s governing body and spoke in favour of Planning Application 03/P/0977/RG3 (Minute No. WAC 15 refers).  She referred to problems that had been experienced in the past and the benefits of being able to install a perimeter fence if the Committee so decided.

Mr. P. Downes, agent for the applicant addressed the Committee in favour of Planning Application 00/P/0566/F (Minute No. WAC 11 refers).  He referred to his clients’ commitment to invest in Weston-super-Mare, the long-standing relationship in the town, and the provision of employment opportunity.

Councillor Parker declared a non-prejudicial personal interest in Agenda Item 6.8 – the applicant is a builder and had recently been employed to carry out works on his home.

            RESOLVED: that the minutes of the meeting be approved as a correct record and signed by the Chairman.

Minutes of the Site Inspection held on 15th May 2003 (Agenda Item 4.2)

 

Members noted that the site meeting due to be held on 15th May had been cancelled due to a clash of meetings with Weston-super-Mare Town Council.  A large number of the Committee had indicated that they would not be able to attend the site meeting.

 

PART 1 – RECOMMENDATIONS TO THE PLANNING AND REGULATORY COMMITTEE

Application 01/P/2301/F – Residential development of 36 dwellings and access road and public open space on land at the Cornfields, Ebdon Grounds, Wick St. Lawrence (Agenda Item 6.1)

 

The Acting Director of Development and Environment reported on the above application.  He referred to the update sheet, a copy of which is filed on the signed minute book.

 

RESOLVED:  that the application be REFUSED for the following reason:

 

The proposal has given insufficient recognition of the community need for open space and would result in the loss of potential public open space, which would be detrimental to the needs of the local community and contrary to the spirit of the Recreation policies contained in the adopted North Somerset Local Plan.

Suspension of Standing Orders

 

Members noted that a valid request to speak under Standing Order 17a had been received by the Clerk from Mr S Rendell who was not present at the start of the meeting.  The committee agreed to allow the suspension of standing orders to allow Mr Rendell to speak.

 

RESOLVED:  that Standing Orders be suspended to enable Mr Rendell to address the meeting.

Public Speaking at Planning Committees under Standing Order 17A (Agenda Item 1)

Mr. S Rendell

 

Mr. Rendell addressed the Committee and spoke against Planning Application 03/P/0040/0 (Minute No. WAC 12. refers).  He referred to the steeply sloping rear garden of 44 Farm Road, road access, traffic issues, parking, storm water and sewerage disposal; new plans that had been submitted and inaccuracies contained therein.

PART 2 - DECISIONS OF THE AREA COMMITTEE

11     

Application 00/P/0566/F – Erection of non-food retail warehouse and associated parking and amendments to the existing parking and access to retail park and Uphill  Motors, 74 Winterstoke Road, Weston-super-Mare (Agenda Item 6.2)

 

The Acting Director of Planning and Environment presented the report and referred to the update sheet, a copy of which is filed on the signed Minute Book.

 

RESOLVED:  that the application be APPROVED subject to resolution of the sequential site assessment issues; the receipt of suitably revised plans incorporating traffic calming measures, additional landscaping and improvements to the design of the building and the following conditions:-

 

1.                 The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                 Sale of goods from the retail floorspace hereby approved shall be restricted to the sale of bulky goods, including DIY/hardware, garden products, furniture, floor coverings, soft furnishings, electrical goods, pet products, golf equipment, motor accessories and office equipment. The retail warehouse will not sell food (other than confectionery), clothing (including sports wear, sports shoes and children’s wear), fashion shoes, toys, fashion accessories (including handbags), watches, jewellery, perfume, toiletries, books, music, records and video and audio tapes without the permission in writing of the Local Planning Authority.

3.                 The retail warehouse hereby permitted shall not be subdivided into smaller separate units without the prior permission of the Local Planning Authority.

4.                 The retail warehouse shall be constructed in accordance with the approved plans and no additional mezzanine floor shall be constructed without the prior permission in writing from the local planning authority.

5.                 No works shall commence until samples and /or sample panels of external materials, including for walls, roofs, fenestration, doors and surfacing materials including paviours have been constructed on site or submitted for the approval of the Local Planning Authority. No work shall commence until the written approval of the Local Planning Authority to the materials has first been obtained and no variations to the approved details shall take place without the written approval of the Local Planning Authority.

6.                 The retail warehouse hereby permitted shall not be open for trading until the highway improvements have been fully implemented in accordance with the approved plans.

7.                 The retail warehouse hereby permitted shall not be open for trading until the cycle parking stands have been fully constructed in accordance with plans to be submitted to and approved in writing by the Local Planning Authority.

8.         No development shall commence until drawings which show the proposed buildings in relation to the culverted Uphill Great Rhyne which crosses the site have been submitted to and approved in writing by the Local Planning Authority.

9.         No development shall commence until drainage details have been submitted to and approved by the Local Planning Authority. Such works shall be carried out concurrently with the development to a programme to be submitted to and approved in writing by the Local Planning Authority.

10.       No development shall take place until full details of a landscaping scheme which shall accord with the principles shown on the revised layout plan no 643-002 rev F have been submitted to and approved, in writing,  by the Local Planning Authority.

11.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the warehouse or completion of the development, whichever is the sooner.

12.              Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority  or die, become seriously diseased or are damaged, shall be replaced in the first available planting season  with others of such species and size as the Authority may specify.

13.              Prior to commencement of works, full details of traffic calming measures and revisions to the accesses shall be submitted to and approved in writing by the Local Planning Authority, the details shall ensure that there is no access from the public and staff car parks to Winterstoke Road at any time.

14.              Prior to occupation of the development the approved revisions to the access and car parking shall be carried out in full unless revised details are first submitted to and approved in writing by the Local Planning Authority.

15.              Prior to the occupation of the building hereby approved full details of the provision for cycle parking shall be submitted to and approved, in writing, by the Local Planning Authority and the approved scheme carried out in full.

16.               Prior to commencement of the works details of the design and materials of the security and boundary fencing and access gates shall be submitted to and approved in writing by the Local Planning Authority.  The works shall be carried out in accordance with the approved scheme unless revised plans are first submitted and approved in writing by the Local Planning Authority

 

Advice notes

 

1.         You are advised that petrol interceptors must be installed to protect the receiving watercourses in accordance with the required specifications from the Environment Agency.

 

2.                   Under the terms of the Water Resources Act 1991 and the Land Drainage Bylaws the prior written consent of the Environment Agency is required for any proposed works or structures in, on, over or under or within 8m of the edge of the culverted Uphill Great Rhyne (a designated main river.)

3.                 The applicant will need to enter into an agreement with the local planning authority for the design and implementation of any works on the public highway.  The applicant is advised to contact Highway Services on 01275 882001.

Application No. 03/P/0049/O – Construction of one two storey dwelling with garage and vehicular access fronting Fairfield Close, Weston-super-Mare (Agenda Item 6.3)

 

The Acting Director of Development and Environment reported on the following application and referred to the update sheet, a copy of which can be found on the signed minute book.

 

RESOLVED:   that the application be REFUSED for the following reasons:-

 

The construction of a two storey dwelling with garage and vehicular access fronting Fairfield Close would result in an overdevelopment of the site detrimental to the character and appearance of the area and the amenities of neighbouring residents contrary to policy HOU/2 of the North Somerset Local Plan and Policy H/7 of the Draft North Somerset Replacement Local Plan.

Application 03/P/0977/RG3 – Installation of perimeter security fence at Castle Batch Primary School, Rawlins Avenue, Weston-super-Mare (Agenda Item 6.6)

 

The Acting Director of Development and Environment reported on the above application and referred to the update sheet, a copy of which can be found on the signed Minute Book.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.                  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                   No work shall be commenced until a sample of the green colour coating of the gate and fencing hereby permitted is submitted and approved in writing by the Local Planning Authority.

3.                  Within three months of the erection of the fence and gates they shall be treated in the approved colour.

Application 03/P/0717/F – Proposed new door and window and construction of a new wooden decking on the beach for seating for café use at Carlton Kiosk, Marine Parade, Weston-super-Mare (Agenda Item 6.7)

 

The Acting Director of Development and Environment reported on the above application and referred to the update sheet, a copy of which can be found on the signed minute book.

 

RESOLVED:  that the application be APPROVED subject to no objection from English Nature to the test of “likely significant effect” and the following conditions:

 

1.                  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.                  The exiting stone steps to the north-west of the site shall remain undisturbed and shall be fully protected during the course of the works on site.

Timing of Meetings

 

At the request of Council on the 13th May 2003 it was determined that each Committee decide the timings of their meeting.

 

RESOLVED:  that meetings of the West Area Committee will now meet at 6.00 p.m. either on Wednesday or Thursday dependant on the decision of the South Area Committee to be held later in the day.

Area Forum

 

The Chairman in view of concerns regarding consultations on road layout on Beach Lawns and the Tropicana suggested at an Area Forum meeting be arranged..

 

RESOLVED:  that an Area Forum meeting to consider the issue of the above be held prior to the decision by the Executive Member for Strategic Planning.
