Planning Application No. 03/P/0524/F Erection of 6 no. four, three and two bedroom houses.  Formation of new access road.  Demolition of Old Rectory Garage, stores, rear porch and greenhouse at The Rectory, Church Road South, Portishead (Agenda Item 6.1)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:  that Planning Application No. 03/P/0524/F be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       No works shall commence in connection with the development hereby approved until the developer has confirmed and agreed in writing with the Local Planning Authority the destination and method of disposal of all materials from the buildings to be demolished on the site and shall include details of how the materials are to be removed from the site and over what period of time.

3.       No work relating to the construction of the development hereby approved, including works of demolition or preparation prior to operations shall take place between the hours of 07.00 hours nor after 19.30 hours Monday to Friday, before the hours of 07.00 hours nor after 19.30 hours Saturdays nor shall there be any construction (including demolition works) carried out on Sundays or recognised public holidays, unless otherwise agreed by the Local Planning Authority, in writing.

4.       No works shall commence on site until details providing for the protection of the existing Badgers and their respective setts on site have been submitted to and approved by the Local Planning Authority in accordance with the requirements of English Nature. The submitted details shall incorporate above and below ground means of fencing / enclosure around the sett(s) and shall include protective measures to the existing Badger corridor routes that run approximately adjacent to the east, south and south east boundaries of the site, including the area of land edged blue on the submitted plan hereby approved.

5.       No works shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The development shall be carried out in the approved materials unless otherwise agreed in writing.

6.       No works shall commence until the Local Planning Authority has been given at least seven days’ notice of the intention to start work on site.

7.       The developer shall afford access at all times to any archaeologist nominated by the Local Planning Authority, and shall allow him or her to observe the excavations and record items of interest and finds.

8.       The proposed stone wall that extends along the edge of the access drive to form the enclosure to the front garden of the existing Rectory shall be constructed prior to the occupation of the new dwellings hereby approved and shall furthermore be constructed using natural stone that matches exactly the type and pointing used in the existing front boundary wall that adjoins Church Road South.

9.       No walls shall be constructed or rebuilt until sample panels (approximately 1 metre square) of the stonework and brickwork demonstrating the colour, texture, face bond, and pointing are erected on site and approved in writing by the Local Planning Authority. The development shall be completed in accordance with the approved details.

10.     The finished floor, ground and ridge height levels shall not exceed those shown on the approved plans.

11.     There shall be no burning of materials on site during the implementation and construction of the development hereby approved.

12.     The dwellings shall not be occupied until a means of access has been constructed in accordance with the approved plans.

13.     No dwelling shall be occupied until space for one garage and one parked car has been provided for it together with vehicular access thereto in accordance with the approved plans. The access and spaces for garage and parking shall be used for no other purpose.

14.     Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no extensions or external alterations, including the insertion of any additional windows, to the dwellings hereby approved shall be carried out without the permission, in writing, of the Local Planning Authority.

15.     Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional garage(s), shall be erected within the curtilage of the dwellings hereby permitted without the written permission of the Local Planning Authority and the approval by them of the design, siting and external appearance of such structure.

16.     No development shall take place until a programme of tree surgery works in respect of the existing trees on the site have been submitted to and approved, in writing, by the Local Planning Authority.

17.     No development shall take place until additional landscape details have been submitted to and approved, in writing, by the Local Planning Authority.

18.     For the duration of the development works existing trees shall be protected by a suitable barrier erected and maintained at a distance from the trunk or hedge specified, in writing, by the Local Planning Authority. The Authority shall be informed at least seven days before works start on site so that barrier position can be established. Within this protected area there shall be no excavation, tipping or stacking, nor compaction of the ground by any other means.

19.     All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the dwellings or completion of the development, whichever is the sooner.

20.  Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

RESOLVED:   that Planning Application No. 03/P/0275/F be APPROVED subject to the following conditions:

 

1.      The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.      MO24 – external walling and roofing materials. 

3.      No work shall take place until details of the garage door to the front elevation of the extension hereby approved have been submitted to and approved in writing, by the Local Planning Authority.

4.      Notwithstanding the provisions of the town and Country Planning (General Permitted Development) Order 1995, or any order revoking or re-enacting that order, no additional windows to those shown on the approved plans shall be inserted into south west elevation of the extension hereby approved without the prior written consent of the Local Planning Authority.

The Solicitor to the Council reported on an application for a Certificate of Lawfulness.

 

RESOLVED:  that a Certificate of lawfulness be granted for the proposed development of a rear extension at 4 Galingale Way, Portishead, in accordance with the information and drawings submitted with the application, on the grounds that the development is permitted development in accordance with the provisions of Class A of Part 1 of Schedule 2 Town and Country Planning (General Permitted Development) Order 1995.

Area Committee Budget Bidding (Agenda item 8)

 

The Area Committee considered applications submitted for financial assistance under the Budget Bidding Process.

 

RECOMMENDED TO THE LEADER OF THE COUNCIL:

 

(1)     that the application submitted by the Weston-in-Gordano Village Hall Management Committee and Councillor Ashton for the provision of insulation to the walls and roof of the village hall as part of a wider refurbishment project, be approved in the sum of £1,891; and
