Mr Chris Hunt addressed the Area Committee in respect of an application for planning permission (Minute No. NAC 203 refers).  On behalf of residents of All Saints Lane, Mr Hunt drew Members attention to concerns about over-cramming, highway safety, loss of privacy, and also that the proposal was out of keeping with the character of the area.

Planning Application No. 02/P/2753/F – Alterations and extensions to existing dwelling to include partial demolition and roof alterations and construction of terraced area at Lime Breach, Cadbury Camp Lane, Tickenham (Agenda 6.2)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

Members of the Area Committee agreed that permission should be granted, for the following reasons:

 

i)       the scale and size of the proposed extensions would not be a disproportional addition and would not harm the openness or purpose of the Green Belt, therefore GRB/4 would not apply;

ii)      that the proposal was in accord with Para 41 of PPG3 having regard to the building in its locality;

iii)      and that the proposals were wholly in accord with RL/6, in that the building works would greatly enhance the visual amenities and correct the present damaging impact of past ill-conceived extensions.

 

Under the provisions of Part 3.1(b) of the Constitution, this matter was reserved to the Planning and Regulatory Committee for determination, as the decision taken by the Area Committee was not in accordance with the officers’ recommendation and could have serious policy implications for the Local Planning Authority.

 

RECCOMMENDED TO THE PLANNING AND REGULATORY COMMITTEE:  that Planning Application No. 02/P/2753/F be APPROVED subject to suitable conditions.

 


PART 2 – DECISIONS OF THE AREA COMMITTEE

Planning Application Nos. 02/P/2406/F and 02/P/2407/LB – Demolition of existing extension to Ham Green House and mortuary building. Erection of two/three storey linked extension to form new accommodation for the Bristol Cancer Help Centre at Ham Green House, Chapel Pill Lane, Pill (Agenda Item 6.1)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:

 

(1)     that subject to the referral of the application to the Secretary of State as a departure from the Development Plan, Planning Application No 02/P/2406/F be APPROVED subject to the following conditions:-

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       The development hereby permitted shall be carried out in complete accordance with the approved plans and specifications (unless amended plans and specifications are first submitted to and approved, in writing, by the Local Planning Authority).

3.       No work shall be commenced until samples of the materials to be used in the development have been submitted to and approved, in writing, by the Local Planning Authority.  The developments shall be carried out in the approved materials unless otherwise agreed in writing.

4.       No walls shall be constructed until sample panels of the external walls demonstrating the colour and texture are erected on site and approved in writing by the Local Planning Authority.

5.       No development shall take place until a detailed landscaping scheme has been submitted to and approved in writing by the Local Planning Authority.

6.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the building or the completion of the development, whichever is the sooner.

7.       For the duration of development works, the existing cedar tree to the south of Ham Green house shall be protected by a suitable barrier erected and maintained at a distance from the trunk, in writing, by the Local Planning Authority.  The Authority shall be informed at least seven days before work starts on site so that the barrier position can be established.  Within this protected area, there shall be no excavation, tipping or stacking, nor compaction of the grounds by other means.

8.       Trees, hedges and plants shown in the landcsaping scheme to be retained or planted which, during the development works or a period of ten years following the full implementation of the landscaping scheme, are removed without the prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

9.       Any such tree or hedge which during that time is removed or dies, or becomes severely damaged or seriopusly diseased shall be replaced with trees or hedging plants of such size and species and at such time as may be specified by the Local Planning Authority.

10.     Any works necessary to the Cedar tree to the south of the Ham Green House shall be carried out in accordance with the recommendations of an independent tree surgeon whose report shall be submitted to the Local Planning Authority for approval, in writing, prior to work commencing.

11.     No development approved by this permission shall be commenced until a scheme for the provision of surface water drainage works has been submitted to and approved in writing by the Local Planning Authority.  The drainage works shall be completed in accordance with the details and timetable agreed.

12.     The necessary off-site drainage works required to service the proposed development must be completed before the development is commenced.

13.     No development shall be commenced on site until final details of the laying out of the car parking/circulation areas have been submitted to and approved by the Local Planning Authority. The buildings shall not be occupied until the parking area has been constructed and the parking spaces marked out in accordance with the approved plan and shall not be used except for the parking of vehicles in connection with the development hereby approved.

14.     No development shall be commenced on site until samples of all hard surface materials to be used in the development have been submitted to and approved in writing by the Local Planning Authority.  The developments shall be carried out in the approved materials unless otherwise agreed in writing.

15.     Details of the design and location of the proposed cycle racks shall be submitted to and agreed in writing by the Local Planning Authority before development commences and the cycle racks shall be provided on site in accordance with the approved details prior to the ocupation of the buildings.

16.     Prior to the occupation of the buildings herby approved, Green Travel Plans shall be submitted to and approved in writing by the Local Planning Authority.  The approved plan shall be implemented in accordance with the approved details and shall be made available for monitoring purposes by the Local Planning Authority.

17.     No external means of illumination shall be used on the site unless details of the lighting have first been approved in writing by the Local Planning Authority.

18.     All materials arising from the existing building and structures to be demolished shall be removed from the site and disposed of to an authorised waste disposal site.

19.     Details of the flue extraction system/s associated with the kitchens, including noise control must be submitted to and approved by the Local Planning Authority prior to development commencing. Details of any subsequent additions or alteratsions of the extract system/s shall be submitted to and appropved in writing by the local planning authority prior to work being carried out.

20.     Noise arising from any fixed plant, including extraction, ventilation and refrigeration equipment, shall be inaudible at the boundary of nearby residential properties.  With regards to the kitchen extraction systems sufficient noise attenuation/control needs to be submitted in pursuance of condition 19 to ensure that this condition will be satisfied.

21.     The developer shall afford access at all times to any archaeologist nominated by the Local Planning Authority, and shall allow him or her to observe the excavations and record items of interest and finds.

22.     The Local Planning Authority shall in respect of archaeological interest be given a minimum of three weeks notice of the developer's intention to commence operations on site.

23.        Details of the provision to be made for the parking and turning on site of operatives and construction vehicles and the position of any cabins/site offices required during the contract period shall be submitted to and approved, in writing, by the Local Planning Authority.  Such measures shall be retained and fully used for the duration of the construction period;

24.    Prior to the occupation of the development hereby approved the footpath link to Chapel Pill Lane shall be fully implemented in accordance with the approved details.

25.    The construction of the footpath link to Chapel Pill Lane hereby approved shall follow guidelines for 'no-dig' construction as specified in Arboricultural Practice Note 1 (APN1).

26.     Details of the materials to be used in the development, including those to be re-used on the development following the demolition of buildings shall be submitted to and approved in writing by the Local Planning Authority.

 

(2)     that subject to the application being referred to the Secretary of State (given the demolition of a substantial part of the listed building application), Listed Building Application No 02/P/2407/LB be APPROVED subject to the following conditions:-

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       The existing barn is to be retained as on the approved drawings.  A schedule of works for its restoration must be submitted and approved in writing by the local Planning Authority before any work is carried out.

3.       A listed building application for the repair and restoration of the Gazebo must be obtained before the first occupation of Ham Green House.  The approved works must be carried out within 12 months of the consent.

4.       No work shall be commenced until samples of the materials to be used in the development have been submitted to and approved, in writing, by the Local Planning Authority.  The developments shall be carried out in the approved materials unless otherwise agreed in writing.

5.       No walls shall be constructed or rebuilt until sample panels of the external walls demonstrating the colour and texture are erected on site and approved in writing by the Local Planning Authority.

6.       No works shall be commenced until detailed working drawings at a scale of not less of 1:20 showing a cross section of the architectural detail of the extension hereby approved have been submitted to and approved in writing by the Local Planning Authority.

7.       All existing internal decoration features, including plasterwork, ironwork, fireplaces, doors, windows, staircases, balustrading and other woodwork, shall remain undisturbed in their existing positions, and shall be fully protected during the course of works on site unless expressly specified in the drawings hereby approved.

8.       All new external and internal works and finishes, and works of making good, shall match the existing original work in respect of materials used, detailed execution and finished appearance except where indicated otherwise on the drawings hereby approved.

9.       No works shall be commenced until a detailed schedule of works to the internal doors (including drawings where appropriate) has been submitted to and approved, in writing, by the Local Planning Authority.

10.     No works shall be commenced until detailed working drawings (plans and elevations), at a scale of not less of 1:20 showing of the proposed staircase in rooms F17 and S18 have been submitted to and approved in writing by the Local Planning Authority.

11.     No works shall be commenced until details in plan and elevation form at a scale of not less of 1:20 showing of the proposed new windows in the northern elevation of the main house have been submitted to and approved in writing by the Local Planning Authority.

12.        No works shall be commenced until detailed working drawings at a scale of not less of 1:20 (including sections) showing the proposed external glazing on the north and west elevation of the extension hereby approved have been submitted to and approved in writing by the Local Planning Authority.

13.     No works shall be commenced until details of the proposed rooflights have been submitted to and approved in writing by the Local Planning Authority.

14      No works shall be commenced until detailed working drawings at a scale of not less of 1:20 showing of the proposed latern light in the south west corner of the extension hereby approved have been submitted to and approved in writing by the Local Planning Authority.

15.     Details of all/any ventilation installations associated with the development hereby approved shall be submitted to and approved by the Local Planning Authority prior to work commencing. The approved detail shall thereafter be carried out strictly in accordance with the approved plans.

RESOLVED: 

 

(1)     that Planning Application No. 02/P/2159/F be REFUSED on the following grounds:

 

1.       The proposal would have an unacceptable impact on the amenity of nearby residents by reason of noise, smell, light, and loss of privacy contrary to policies ENV/1, ENV/2, RL/1and S/11 of the North Somerset Local Plan.

2.            Inadequate provision is made for car parking contrary to policy T/13 of the North Somerset Local Plan to Policy ENV/2.

 

(2)     that Listed Building Application No. 02/P/2162/LB be DEFERRED.

RESOLVED:  that Planning Application No. 03/P/0271/RG3 be REFUSED on the following grounds:-

 

1.            The proposal constitutes an overdevelopment of the site which would have an adverse effect on the character of the area contrary to policy HOU/2 of the North Somerset Local Plan.

Planning Application No. 03/P/0031/F – Erection of two no. detached office buildings (Class B1) with associated car parking, land at Eden Office Park, Ham Green, Easton in Gordano (Agenda Item 6.5)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:  that subject to the completion of a legal agreement to bind the developers into the obligations of the Section 106 Agreement relating to planning approval 97/0828 which are relevant to the current application site, Planning Application No. 03/P/0031/F be APPROVED subject to the following conditions:-

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       No development shall take place until a detailed landscaping scheme has been submitted to and approved in writing by the Local Planning Authority.

3.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the building or the completion of the development, whichever is the sooner.

1.            The proposal would be a cramped form of development detrimental to the amenities of the adjoining properties, out of keeping with the character of the area, and with inadequate parking provision contrary to policies HOU/2 and RL/1 of the North Somerset Local Plan.

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED: 

 

(1)     that Planning Application No. 03/P/0177/F be REFUSED for the following reason:-

 

1.       The increase in the scale of operations by virtue of the sale of materials from the site and the associated increase in the level of activity would result in a sporadic development in open countryside and harm to the rural character of the area. The proposal is therefore contrary to Policy S/4 of the North Somerset Local Plan.

 

(2)     that ENFORCEMENT ACTION including any court action if applicable, be taken to remedy the breach of planning control subject to consultation between the Director of Development and Environment and the Solicitor to the Council.

RESOLVED: that Planning Application No. 03/P/0239/F be APPROVED subject to the following conditions:-

 

1.            The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.            The external walling and roofing materials to be used in the building works hereby permitted shall be identical to those in the existing building.  If any other material is proposed no development shall take place until such has been approved, in writing, by the Local Planning Authority.

3.            Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows shall be inserted in the east elevation without the prior written consent of the Local Planning Authority.

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:  that Planning Application No. 03/P/0061/F be APPROVED subject to the following conditions:-

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       Notwithstanding the submitted plans, a hedge shall be planted on the St Joseph’s school side of the fence in accordance with details to be submitted to and approved in writing by the Local Planning Authority, prior to the erection of the approved fence. The agreed hedge, which shall comprise native species, shall thereafter be planted in the first available planting season following erection of the fence.  Any part of the hedge that, within a period of 10 years from planting, dies, becomes diseased or is otherwise lost shall be replaced with the same species.

3.       Details of the proposed gates shall be submitted to and approved in writing by the Local Planning Authority prior to the erection of the fence.

Appeal Decisions

 

02/P/0008/F – Appeal by Lidl UK GmbH in respect of an application for the extension to existing foodstore to provide additional retail floorspace at Great Western Road, Clevedon.  APPEAL ALLOWED.

 

02/P/1451/F – Appeal by Mr and Mrs Hadlow in respect of an application for a change of use to a health club, Ground and Lower Ground Floors, Dash House, 13 Alexandra Road, Clevedon.  APPEAL DISMISSED.

 

02/P/0769/F – Appeal by South Gloucester Commercials Limited in respect of variation of condition attached to a planning permission (Ref. 3587/88) dated 20th April 1989 for the permitted use to be restricted to that of a workshop for repair of machinery and vehicles at Depot, 61 Caswell Lane, Clapton in Gordano.  APPEAL DISMISSED.

Draft Planning Enforcement Protocol (Agenda Item 6.13)

 

The Director of Development and Environment submitted a report which gave details of a proposed enforcement protocol for guiding priorities in respect of enforcement action.

 

Councillor Clark commended the use of plain English in the report.  Referring to the order of priorities, he felt that unauthorised development or activity likely to cause harm or danger had greater significance than the protection of trees. 

 

The Development Control Manager, Richard Kent, referred to the permanent nature of tree felling.  Preservation Orders were issued to guard against unauthorised works. 

Councillor Shopland believed that as felled trees were clearly not capable of re-instatement, the use of enforcement action was inappropriate for their protection as its purpose was to restore the position that had existed before the breach of planning control.

 

Councillor Walters referred to the flowchart illustrating complaint handling, and to the instruction of Solicitors should enforcement action be authorised.  Richard Kent assured Members that legal advice was sought, as required, throughout the process

 

Members also discussed non-compliance with Section 106 Agreements, and the procedure for dealing with enforcement complaints.

The Solicitor to the Council submitted a report advising receipt of an application for a Certificate of Lawfulness for an existing use of 13 Springfield Road, Pill as two self-contained flats.

 

RESOLVED:  that a Certificate of Lawfulness for an Existing Use of 13 Springfield Road, Pill as two self-contained flats (on ground floor and first floor) be granted on the ground that the use began more than ten years before the date of the application.
