7                    Urgent Business permitted by the Local Government Act 1972

Any item of business which the Chairman is of the opinion should be considered at the meeting as a matter of urgency by reason of special circumstances (to be specified in the Minutes).  For a matter to be considered as an urgent item, the following questions must be addressed:

"What harm to the public interest would flow from leaving it until the next meeting?" If harm can be demonstrated, then it is open to the Chairman to rule that it be considered as urgent.  Otherwise the matter cannot be considered urgent within the statutory provisions.

02/P/2003/F – Proposed change of use of former school building into four dwellings, removal of other school building and erection of four new dwellings at former Churchill Primary School, Ladymead Lane, Churchill (Agenda Item 6.2)

 

The Director of Planning and Environment presented the report, and drew, and drew members attention to the update report, a copy of which is filed on the signed minute book.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.            The development hereby permitted shall be begun either before the expiry of five years from the date of this permission.

2.            No dwellings hereby permitted shall be occupied until the alterations to the access at Ladymead Lane including new boundary walls; junction improvements at Ladymead Lane and Bristol Road and car parking spaces have been constructed in accordance with the approved drawings.  The car parking spaces including garages shall be retained for car parking at all times, and shall not be obstructed, used or converted for any other purposes without the prior consent of the Local Planning Authority.

3.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no extensions or external alterations to the dwelling shall be carried out without the permission, in writing, of the Local Planning Authority.

4.            The finished floor levels and ridge heights of the new dwellings at Plot 5 to 8 inclusive shall not exceed those shown in the approved drawings.

5.       No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

6.       No development shall be commenced until drainage details including land drainage where applicable have been submitted to and approved by the Local Planning Authority.  Such works shall be carried out concurrently with the development to a programme to be agreed and approved, in writing, by the Local Planning Authority.

7.       No development shall take place until details of a landscaping scheme have been submitted to and approved, in writing, by the Local Planning Authority.

8.       For the duration of the development works existing trees shall be protected by a suitable barrier erected and maintained at a distance from the trunk or hedge specified, in writing, by the Local Planning Authority.  The Authority shall be informed at least seven days before works start on site so that barrier position can be established.  Within this protected area there shall be no excavation, tipping or stacking, nor compaction of the ground by any other means.

9.       All works comprised in the approved details of landscaping should be carried out during the months of October to March inclusive following occupation of the building or completion of the development, whichever is the sooner.

10.     Trees, hedges and plants shown in the landscaping scheme to be retained or planted which, during the development works or a period of ten years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

The Director of Planning and Environment presented a report.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.            The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.            The colour stain for the structure hereby approved, shall be agreed in writing with the Local Planning Authority and the structure shall be stained in the approved colour within one month of the date of this permission.

The Director of Planning and Environment presented a report.  He explained that the site plan indicated No 2 The Barton and pointed out where the location of No 3 The Barton was on the location map, to ensure the correct location was discussed.

 

RESOLVED:  that the application be APPROVED subject to the following conditions:-

 

1.  The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, the window on the east elevation shall be glazed permanently with obscure glazing and with the exception of the small top light shall be non opening and fixed shut permanently.

3.  Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, rooflights or dormers shall be inserted in the north or east elevation without the prior written consent of the Local Planning Authority.

02/P/2490/F – Retrospective change of use of barn from agricultural to general storage use at farm building at Honeyhall Lane, Congresbury (Agenda Item 6.5)

 

RESOLVED:  (1) that the application be REFUSED for the following reasons:-

 

1.            The proposed B8 use would introduce additional traffic into a rural location to the detriment of the character of the area and the amenities of local residents, contrary to the advice within PPG 13: ‘Transport’, the aims of Policy T/11 and policy DCS/3 of the North Somerset Local Plan.

2.            The form and design of the building is out of keeping with the surrounding area and its re-use would be contrary to section (iii) of policy DCS/3 of the North Somerset Local Plan and policy RD/3 of the North Somerset Replacement Local Plan (First Deposit Draft);

 

(2) that ENFORCEMENT ACTION including any court action if applicable, be taken to remedy the breach of planning control of the barn, shipping containers, caravan and land and subject to consultation with the Director of Development and Environment and the Solicitor to the Council.

The Committee considered a report from the Head of Corporate Policy presenting applications for financial assistance under the budget bidding process.

Application for Certificate of Lawfulness for an Existing Use of parking and storage of all classes of motor vehicles, mostly heavy goods vehicles, and ancillary storage at land forming part of Big Bullocks Farm, Felton (Application No 02/P/1383/LUE) (Agenda Item 8)

 

Members received a report from the Solicitor to the Council on an application for a Certificate of Lawfulness for an Existing Use of parking and storage of all classes of motor vehicles, mostly heavy goods vehicles, and ancillary storage at land forming part of Big Bullocks Farm, Felton.

 

RESOLVED:  that a Certificate of Lawfulness be granted for an existing use of part of Big Bullocks Farm (as shown edged in black on the plan now submitted - a copy is filed on the signed Minute Book) for the parking and storage, on the ground, of up to 20 damaged motor vehicles of all classes and up to 4 vehicle recovery vehicles.  The reason is that the applicant has proved on the balance of probabilities that this use began more than 10 years before the date of the application.  There is insufficient precise and unambiguous evidence to justify a wider use on the balance of probabilities.

St Georges Parish Council  

 

“What degree of supervision is taking place on the St Georges developments, particularly with regard to the works required by the 106 Agreements, now long overdue?”

 

Mr Warren, Clerk of St Georges parish council, drew members’ attention to his Parish Council’s concerns regarding the above.  He gave instances where the requirements of Section 106 Agreements had not been met and were long overdue.

 

Officers advised that a meeting with one of the developers had been arranged and that some of the points would be addressed.

 

Debate followed on possible mechanisms to ensure compliance of Section 106 Agreements by Developers.

 

Mr Warren further made comment on the need to be kept informed of situations.

 

Officers offered to facilitate meetings between Local Members and the  Parish Council on a 4-6 week basis, whilst building developments were in progress, to advise on current situations.
