7                    Urgent Business permitted by the Local Government Act 1972

Any item of business which the Chairman is of the opinion should be considered at the meeting as a matter of urgency by reason of special circumstances (to be specified in the Minutes).  For a matter to be considered as an urgent item, the following questions must be addressed:

 

"What harm to the public interest would flow from leaving it until the next meeting?" If harm can be demonstrated, then it is open to the Chairman to rule that it be considered as urgent.  Otherwise the matter cannot be considered urgent within the statutory provisions.

 

 

 

 

 


EXEMPT ITEMS

 

Should the Committee wish to consider a matter as an Exempt Item, the Committee will be invited to pass the following resolution –

Public participation statement under Standing Order 17

Mr Tim Jones

 

Mr Jones, a resident of Clevedon, addressed the Area Committee in respect of drug pushing in Clevedon.

 

Mr Jones told Members that drugs were sold openly to vulnerable young people in the triangle shopping area. He had reported these activities to the police, but had been disappointed by the response received.  Mr Jones also presented a petition containing signatures of approximately 83 local residents and business people.  The petition was in the terms “Keep shopping area drug-free”.

 

Members expressed concern at the apparent lack of action, and agreed that the petition be forwarded to the Leader of Council and that he be requested bring this matter to the attention of the Police.

 

The Chairman thanked Mr Jones for bringing this matter to the Council’s attention.

Public speaking at planning committees under Standing Order 17A

Mr Don Fry

 

Mr Fry, an objector to an application for planning permission at Byways, Strode Road, Clevedon, urged the Area Committee to reject the proposal as submitted (Minute No. 166 refers). He was concerned about over-development of the site, potential disruption arising from construction works, and highway safety. He told Members that residents of the mobile home park were unanimously opposed to the application.

 

The Chairman thanked Mr Fry for speaking to the Area Committee.

02/P/2565/MP Phase 1 Sub-Area Masterplan, The Ashlands, Portishead (Agenda Item 7.1)

 

The Director of Development and Environment reported the submission of a sub-area masterplan in compliance with The Ashlands Section 106 Agreement. The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

Members expressed concern about the provision of affordable housing and house size mix, inadequacy of car parking provision, instability of the ground being built on, and disappointment at the apparent lack of consultation with the parish councils concerned.

 

In accordance with the provisions of Part 3 (1b) of the Constitution, the Chairman exercised his right to refer the matter to the Planning and Regulatory Committee, unconditionally upon any particular resolution having been adopted by the Area Committee.

 

RECOMMENDED:   that subject to consideration of the comments of Portbury Parish Council, the Area 1 sub-area masterplan be APPROVED and be used as the basis for the determination of reserved matters applications within the boundaries of the site, subject to Planning Permission 00/P/1844/OT2 granted on 30th August 2002.

Planning Application No 02/P/2019/O – Erection of 17 dwellings and means of access from Strode Road (Outline) at Byways, Strode Road, Clevedon (Agenda Item 7.2)

 

The Director of Development and Environment reported on an application for planning permission.  The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:  that Planning Application No. 02/P/2019/O be REFUSED for the following reasons:

 

1.      The proposal would constitute over development of the site which would have an adverse impact on the amenities of adjoining residents and generate an unacceptable increase in traffic contrary to policy HOU/2 of the NSLP.

2.      Insufficient information has been submitted to demonstrate that the development would not have an unacceptable impact on flood risk in the locality contrary to policy ENV/6 of the NSLP and policy 24 of the Joint Replacement Structure Plan.

3.      In the absence of an appropriate legal agreement, the development makes no provision for public open space contrary to policy R/1 of the North Somerset Local Plan.

4.      The proposal is premature in that insufficient information has been submitted to demonstrate that the site is not unsuitable for development by reason of contamination contrary to policy ENV/5 of the NSLP.

RESOLVED:  that Planning Application No 02/P/2456/F be REFUSED for the following reason:

 

1.            The proposal constitutes the unacceptable over-development of a backland site by reason of its inadequate access and adverse impact on residential amenity contrary to policies HOU/2 and RL/1 of the North Somerset Local Plan.

Planning Application No 02/P/2005/F – Erection of single-storey dwelling and new vehicular access at 286 Down Road, Portishead (Agenda Item 7.5)

 

The Director of Development and Environment reported on an application for planning permission. The Committee was advised of any comments received after the dispatch of the agenda and reports.

 

RESOLVED:  that Planning Application  No 02/P/2005/ F be APPROVED subject to the following conditions:

 

1.            The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.            For the duration of the development works all existing trees and hedges shall be protected by a suitable barrier erected and maintained at a distance from the trunk or hedge specified in writing by the Local Planning Authority.  The Authority shall be informed at least 7 days before work starts on site so that the barrier positions can be established.  Within this protected area there shall be no excavation, tipping or stacking nor compaction of the ground by any other means.

3.            No work shall be commenced until samples of the materials to be used in the development, have been submitted to and approved, in writing, by the Local Planning Authority. The developments shall be carried out in the approved materials unless otherwise agreed in writing.

4.            The dwelling shall not be occupied until a properly consolidated and surfaced parking area for vehicles for that dwelling has been constructed in accordance with plans to be submitted to and approved by the Local Planning Authority.  The approved parking area shall thereafter be kept available for car parking at all times.

5.            All works comprised in the approved details of the landscaping scheme should be carried out during the months of October to March inclusive following occupation of the dwellings or completion of the development, whichever is sooner.

6.            Trees, hedges and plants shown in the landscape scheme to be retained or planted which, during the development works on a period of 10 years following full implementation of the landscaping scheme, are removed without prior written consent from the Local Planning Authority or die, become seriously diseased or are damaged, shall be replaced in the first available planting season with others of such species and size as the Authority may specify.

7.            Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, dormers or openings shall be inserted at first floor level without the prior written consent of the Local Planning Authority.

8.            Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, the dwelling shall not be enlarged or extended without the prior written consent of the Local Planning Authority.

9.            Prior to the commencement of development details of the proposed boundary treatments shall be submitted to and approved by the Local Planning Authority.  The details shall be implemented in full prior to the first occupation of the dwelling.

 

Advice Notes

 

1.            Any works within the highway boundary must be to the Council's specification. Prior to works commencing the developer is requested to contact the Council’s Highways Services Unit at the Nailsea office (01275 882001) to arrange for the works within the highway to be approved and inspected. Such approval is required regardless of any other permissions or consents (eg planning permission) that may be granted by the Council.

2.            There is a culverted watercourse routed across the site and the proposed development will have to accommodate the protection of the watercourse within the design or the diversion of the watercourse.

RESOLVED:  that Planning Application No 02/P/2414/F be APPROVED subject to the following conditions:

 

1.       The development hereby permitted shall be begun before the expiry of five years from the date of this permission.

2.       The development hereby permitted shall be carried out in complete accordance with the approved plans and specifications (unless amended plans and specifications are first submitted to and approved, in writing, by the Local Planning Authority).

3.       The external walling and roofing materials to be used in the building works hereby permitted shall be identical to those in the existing building. If any other material is proposed no development shall take place until such has been approved, in writing, by the Local Planning Authority.

4.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, no additional windows, roof lights or dormers shall be inserted in the north elevation of the extensions without the prior written consent of the Local Planning Authority.

5.       Notwithstanding the provisions of the Town and Country Planning (General Permitted) Development Order 1995, or any order revoking and re-enacting that Order, the windows on the north elevation of the extension shall be glazed permanently with obscured glazing.

6.       No external extraction or heating flue shall be installed in the development hereby permitted unless the location has first been submitted to and approved by the Local Planning Authority.
