RECOMMENDATIONS

 

That the Committee considers the evidence placed before them when determining whether to issue a public Entertainment Licence for The Ebdon Arms, Lilac way, Wick St Lawrence.

 

Summary of Report

 

To consider an application for the Grant of a Public Entertainment Licence at The Ebdon Arms, Lilac Way, Wick St Lawrence.  The requested hours are:

Monday – Saturday between the hours of 11am and Midnight and on Sundays and Bank Holidays from 12 noon and 11pm.

 

1.                  Policy

 

A policy for hours of operation for places of public entertainment was agreed by the Planning and Regulatory Committee on 5 December 2001.  This policy states that Public houses and bars located within suburban or rural locations where noise sensitive properties are within close proximity then normal permitted licensing hours are suggested. Normal liquor licensing hours being Monday – Saturday from 11am until 11pm and Sunday from 12 noon and 10.30pm.  Consideration will be given to a terminal hour of midnight where adequate controls can be placed on the operation of the premises so as to minimise noise and disturbance.  This policy was designed to provide guidance to officers when determining the licensing hours for places of public entertainment and each application should be considered on its own merit.[J1] 

 

2.                  Details

 

An application for the grant of a public entertainment licence was made on the 7 March 2005. The hours of operation requested are as follows:

Monday – Saturday between the hours of 11am and Midnight.  On Sundays and Bank Holidays from 12 noon until 11pm

 

 

 

 

 

3.                  Consultation

 

The Police Licensing Bureau have been consulted on the application and involved with the grant of a new alcohol Licence and they have no objections to the grant of a Public Entertainment Licence for these premises.

 

Environmental Health have been consulted on the application and have no objections on the issue of a Public Entertainment Licence subject to conditions being applied to the Licence.

 

A letter was received from Wick St Lawrence Parish Council in which they oppose the application due to concerns regarding noise emanating from the premises.

 

Fourteen letters have been received from local residents in which they express concerns regarding potential disturbance from the premises.

 

In response to the letters of objection Bond Pearce, solicitors for the applicants, issued a letter that was sent to all objectors outlining their intentions as a result of  which one resident  withdrew their objection.
