Licence
Summary
To collect
money or sell articles for the benefit of charitable or other
purposes you require a street collection licence from us.
The expression
"street" includes any highway and any bridge, road, land, footway,
square, court, alley or passage, whether a thoroughfare or not.
We are
currently unable to control "direct debit" collectors as there is
no physical transfer of goods. The Charities Act 2006 when
implemented will include controls on direct debit collections.
There is no
application fee.
Once a
collection has been completed a formal return has to be made to us
giving details of the donations received and expenses incurred.
You must make
an application to us at least one month before the date that you
want to collect.
Eligibility Criteria
Applications
must be in the form prescribed by us.
We restrict the
number of collections in any particular street or locality and we
may reject an application if another organisation already has been
granted permission to carry out a collection.
You must be a
fit and proper person.
Regulation Summary
The main
legislation covering this permission is the
Police
Factories etc. (Miscellaneous Provisions) Act 1916 (as
amended).
North Somerset
Council has made
regulations which set out the terms and
conditions for carrying out public collections in streets.
Application Evaluation Process
There are no
formal consultation procedures in relation to applications made.
Applications will be assessed on the information provided. If it is
considered necessary the application may be referred to the
Council’s Licensing Sub-Committee for determination.
Will
Tacit Consent Apply?
Yes. This means
that you will be able to act as though your application is granted
if you have not heard from us by the end of the target completion
period of 21 days.

Consumer Complaint
We would always
advise that in the event of a complaint the first contact is made
with the organisation carrying out the collection by you -
preferably in the form a letter (with proof of delivery). If that
has not worked, contact the Licensing Team.
