Street cafes and outdoor seating areas

Licence Summary

 

To place tables, chairs or other temporary furniture on the highway in North Somerset you require a permit from us.

 

The term highway includes public footpaths and pavements.

 

Conditions are attached to permissions granted and a fee is payable. 

 

Policy review consultation

 

We are currently reviewing our Street Cafe Guidelines and a number of changes are being considered. The public consultation on the changes proposed starts on the 17 October 2011 and finishes on the 25 November. We have produced an information sheet which outlines the proposed changes and gives details of how to respond if you wish to make any comments.

 

Eligibility Criteria

 

Street café permits only apply to tables and chairs being placed on a public highway. If the table and chairs are on private land, no permission is required from us.

 

An application must be accompanied by the required fee and the following documents:      

  • Three copies of a 1:1250 scale location plan.
  • Three copies of a 1:100 or 1:50 scale site plan
  • Photographs, brochures or scaled drawings showing design, dimensions, colour and materials of the tables and chairs you propose to use.
  • Photographs, brochures or scaled drawings showing design, dimensions, colour and materials of the proposed means of enclosure.
  • Public liability insurance certification (minimum of £5,000,000 cover)
  • A sample copy of your menu for the proposed licensed area.
  • If appropriate, photographs, brochures or scaled drawings showing design, dimensions, colour and materials of the parasols you propose to use.
  • If appropriate, photographs, brochures or scaled drawings showing design, dimensions, colour and materials of the space heaters you propose to use.
  • Relevant health and safety risk assessments.

 Regulation Summary

 

The main legislation covering this permission is the Highways Act 1980.

 

Application Evaluation Process

 

Public notice of the application must be given detailing the proposal and deadline for representations.

 

All representations received will be considered.

 

Relevant authorities e.g. Police, Fire and Rescue Service, Highways, Environmental Health are consulted as part of the application process.

 

We must not be unreasonably withheld the granting of a Consent if no representations are made against an application made.

  

Will Tacit Consent Apply?

 

Yes. This means that you will be able to act as though your application is granted if you have not heard from us by the end of the target completion period of 42. days.

Consumer Complaint

 

We would always advise that in the event of a complaint the first contact is made with the Consent Holder by you - preferably in the form a letter (with proof of delivery). If that has not worked, contact the Licensing Team.
