Licence Summary
If you trade in
the street in North Somerset you will require a street trading
licence or consent from us.
Conditions are
attached to permissions granted and a
fee is payable.
The legal
definition of a street includes any road, footway, beach or other
area to which the public have access without payment.
Applications
should be made in writing (including by electronic means) to
us.
You must
provide specific information, including details of the street you
wish to trade on and the days and times you wish to trade.
You must comply
with any conditions attached to a licence or consent granted.
Eligibility Criteria
You must be
over 17 years of age to hold a licence.
The main
eligibility criteria for granting licences and consents
are:

The location
of the proposed street trading activity should not present
additional risks to the public in terms of road safety, obstruction
and fire hazard.

The street
trading activity should not present a risk to good public order in
the locality in which it is situated.

The street
trading activity should not present a substantial risk of nuisance
from noise, smells or fumes to households and businesses in the
vicinity of the proposed street trading site.

The presence
of other like trading outlets and proximity of schools and like
educational establishments will be taken into
consideration.

The proposed
street trading activity should be carried out from a trading unit
that complies with the relevant legislation.

Local Government (Miscellaneous Provisions) Act 1982).
Application Evaluation Process
Public notice
of the application must be given detailing the proposal and
deadline for representations. All representations received will be
considered.
Relevant
authorities e.g. Police, Fire and Rescue Service, Highways,
Environmental Health are consulted as part of the application
process.
A hearing will
be held if relevant representations are made in respect of the
application. If a hearing is held the application can be granted or
granted subject to additional conditions or can be rejected.
We must not be
unreasonably withheld the granting of a Consent or Licence if no
representation are made against an application made.
Will
Tacit Consent Apply?
Yes. This means
that you will be able to act as though your application is granted
if you have not heard from us by the end of the target completion
period of 42 days.

court within 21 days of the date you were notified of the

Court.
