We are responsible for keeping the Definitive Map
and Statement (DMS) up to date.
The DMS proves that a Public Right of Way (PROW) legally
exists.
If you know the DMS is wrong then you can put it right by
applying for a Definitive Map Modification Order (DMMO). There is
no charge for this and anyone can apply for a DMMO if you have
enough evidence to prove that:
- a path has not been shown on the DMS that should have been
- a path has been shown on the DMS which should not have
been
- a path has been shown on the DMS but with the wrong status or
alignment
- other details about a path shown on the DMS are incorrect or
missing.
The legal process as set out in Schedule 14 of the Wildlife and
Countryside Act 1981 is complex so it can take a long time to make
the changes.
You can view the DMMO applications we receive on our
Section 53B register.
We also deal with requests to create or dedicate new paths and
process Public Path Order (PPO) applications to change Public
Rights of Way (PROW) under the Highways Act 1980 and the Town and
Country Planning Act 1990.
The Countryside Agency booklet "A guide to definitive maps and
changes to public rights of way" (CA142) is a useful guide
explaining DMMO and PPO application procedures. You can download it
from Natural England.
