Management regulations

Management regulations are a set of conditions which apply exclusively to any Houses in Multiple Occupation (HMO) property within England.

They apply to all HMO properties which share facilities in the private rented sector even if they do not meet HMO licensing requirements.

These Management of Houses in Multiple Occupation (England) Regulations 2006 mean any property with facilities shared by more than two households with people not in the same family must comply with these regulations.
 
The regulations require HMO managers to do the following:

  • Provide occupiers with contact information
  • Maintain all fire safety measures
  • Protect occupiers from injury
  • Maintain water and drainage
  • Maintain gas and electricity supplies
  • Maintain common parts, fixtures and fittings, appliances where provided
  • Ensure properties are clean and fit at the time of letting and maintained
  • Provide waste disposal facilities

Tenants are required to co-operate in the management of the property, avoid nuisance and annoyance to neighbours and other occupiers and comply with reasonable instructions regarding means of escape and other fire precautions.

There is also an additional set of HMO management regulations for self-contained flats under The Housing (Management of Houses in Multiple Occupation) Regulations 1990.

These regulations require HMO managers of these properties to ensure the repair, maintenance and cleaning of the following:

  • All means of water supply and drainage
  • Gas and electricity supplies
  • Common parts of a HMO
  • Installations in common use
  • Living accommodation
  • Windows and ventilation
  • Means of escape from fire
  • Outbuildings and yards in common use

The HMO is also required under the regulation to do the following:

  • Make satisfactory arrangements for refuse and litter disposal
  • Take reasonable precautions for general safety of residents
  • Display notices indicating their name, address and telephone number
  • Inform us about occupancy of the HMO

Tenants are specifically required to allow access to the manager at all reasonable times to carry out these responsibilities and to comply with arrangements to comply with health and safety issues.
