We protect trees in North Somerset by issuing tree
preservation orders (TPOs).
If a protected tree is damaged or destroyed without permission,
the owner or person carrying out the work may be prosecuted and
fined up to £20,000 by magistrates, or more if the case goes to
Crown Court.
If you want to work on a protected tree you must apply for
permission.
There are exemptions if urgent work is required for safety
reasons but you should seek our advice to ensure you do not commit
an offence.

TPOs give legal protection to trees or woodland by preventing
uprooting, topping, lopping, cutting down, wilful damage or
destruction of trees, including cutting roots, without
permission.
The aim is to protect trees for public enjoyment. However, the
responsibility for TPO protected trees, their condition and any
damage they cause remains with the owner.
If the owner considers work is necessary they can apply to us
for advice and help.
A tree covered by a TPO is usually visible from a public place
but in exceptional circumstances other trees may be protected.
Anything that would normally be called a tree may be covered by
a TPO. There is no minimum size but bushes or shrubs cannot be
covered.
In certain circumstances, fruit trees can also be protected,
providing they offer reasonable public amenity.
