Discharge of Conditions

The Government has introduced new fees for the discharge of planning conditions which started on 6 April 2008. Full details about this can be viewed by downloading the Statutory Instrument 958 which was issued by Central Government on 2 April 2008.  We are introducing the charges with effect from the 1 June 2008.

The new fee is payable where a written request is made for the discharge of one or more conditions on the same permission. The fee is payable for each request and not for each condition. For example, if your planning permission was granted subject to 3 conditions that reserved details for approval at a later date and you apply to discharge the first two conditions together and then the third at a later date, you will have to pay two separate fees.

The set fees are £85 per request or £25 where the related permission was for extending or altering a dwelling house or other development within the curtilage of a dwelling house. The fee must be paid when the request is made, it does not matter when the permission was granted. The request, identifying the permission and the conditions concerned can be made using the relevant national application form.

The government encourages authorities to deal with all requests within 8 weeks. The submitted fee will be refundable if there isn't a response sent within 12 weeks from the date of receipt of a valid request. 

Requests to discharge planning conditions or to confirm they have been complied with that are received without the appropriate fee and/or which do not clearly identify both the decision notice and the relevant condition will not be considered. Please note that you must provide whatever detail the condition specifies, for example, samples of materials or a landscape plan (to scale, with scale bar).  Please use the relevant national application form when submitting your request and remember to refer to decision notice reference number.
