Where the law applies

Under the new smoking law you are not allowed to light up in enclosed or substantially enclosed public places.

Premises are enclosed if they have a ceiling or roof and are wholly enclosed on a permanent or temporary basis, except for doors, windows or passageways.  

Premises are substantially enclosed if they have a ceiling or roof with permanent openings in the walls which are less than half of the total area of walls.

This includes other structures which serve as walls. It does not include doors, windows or other fittings which can be opened or shut.  

A roof includes any fixed or movable structures, such as canvas awnings.  

Tents, marquees or similar are classified as enclosed if they fall within the definition.
